Summary: By using Starscapes, you agree to play fair, respect our intellectual property, and understand that virtual purchases are non-refundable.

1. Acceptance of Terms

By downloading, installing, or using Starscapes ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Starscapes is a puzzle game application developed by NDM LABS. The App includes:

Puzzle gameplay across multiple constellations
In-app purchases for virtual currency and items
Game Center leaderboard integration

3. Eligibility

The App is intended for users of all ages. By using the App, you represent that you have the legal capacity to enter into these Terms, or if you are a minor, that you have parental or guardian consent.

4. User Account

Some features of the App require an Apple Game Center account. You are responsible for maintaining the security of your account and for all activities that occur under your account.

5. In-App Purchases

Virtual Items: The App offers virtual currency (Moonstones) and other virtual items for purchase. These items have no real-world value and cannot be exchanged for cash.
Non-Refundable: All purchases are final and non-refundable, except as required by applicable law or Apple's refund policies.
Processing: All payments are processed by Apple through the App Store. We do not have access to your payment information.
Price Changes: We reserve the right to modify prices at any time without prior notice.

6. Intellectual Property

Our Content: All content in the App, including but not limited to graphics, images, text, sounds, and code, is owned by NDM LABS and protected by copyright and other intellectual property laws.
License: We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
Restrictions: You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code.

7. Prohibited Conduct

You agree not to:

Use cheats, exploits, automation software, or any unauthorized third-party software
Modify or interfere with the App's operation
Attempt to gain unauthorized access to the App or its systems
Use the App for any illegal purpose
Harass, abuse, or harm other users
Create multiple accounts to abuse game features or promotions

8. Game Center and Leaderboards

By using Game Center features, you agree to:

Apple's Game Center terms of service
Play fairly without cheating or manipulation
Accept that leaderboard scores may be removed if cheating is detected

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NDM LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF VIRTUAL ITEMS, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless NDM LABS from any claims, damages, losses, or expenses arising from your violation of these Terms or your use of the App.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your license to use the App will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms in the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
